DEFINITION OF TERMS AND CONDITIONS

‘Calico Campers Ltd’: The limited business.
‘The hirer’:
Any person(s) subject to the hire.
‘Rental agreement’:
The document read and signed by the hirer on collection and return of the vehicle.
‘Rental contract’:
The agreement between the hirer and Calico Campers Ltd which is formed upon completion and signatures of the rental agreement and the terms and conditions.
‘The vehicle’:
The vehicle provided by Calico Campers Ltd.
‘Hire period’:
The period of time the vehicle is hired as stipulated in the rental agreement.
‘Security deposit/liability’:
Money provided by the hirer to Calico Campers Ltd to secure performance of a rental agreement or compensate for possible loss or damages.
‘Negligent damage’:
Any damage or loss caused by a negligent act or for damage or loss intentionally caused by the hirer.
‘Overhead area’:
Any area of the vehicle above the level of the windscreen.

  1. RENTAL AGREEMENT
    1. The rental agreement in conjunction with the terms and conditions form the contractual agreement with the hirer and Calico Campers Ltd.
    2. The terms and conditions of this agreement must be read in full including all financial obligations, features and services.
    3. Calico Campers Ltd reserves the right to refuse any rental based on reasonable grounds at their discretion.
  1. RESERVATIONS
    1. All prices quoted are charged in GBP.
    2. Payment is only accepted by credit card (Visa or Mastercard) or debit card (Visa debit etc).
    3. Any reservation is only contractually binding after it has been confirmed by Calico Campers Ltd.
    4. Reservations will not commence without full payment being received.
    5. Reservations will not commence unless all drivers and the hirer agree to these terms and conditions and sign the rental agreement.
  1. PAYMENT TERMS
    1. A booking deposit of 10% of the total hire charge will be required to secure the reservation.
    2. The outstanding balance of the total hire charge must be paid 4 weeks in advance of the hire period start date.
  1. VEHICLE HIRE RATES INCLUDE
    1. Local Tax (VAT).
    2. Unlimited mileage.
    3. Kitchen equipment.
    4. Comprehensive Insurance for a maximum of 3 named drivers who;
      1. Are aged between 23 and 75 during the rental period;
      2. Have held a full UK or EU driving licence for a minimum of 2 years;
      3. Have not had their driving licence suspended for any period within the last 3 years;
      4. Have no more than 6 driving licence penalty points at point of rental;
      5. Have never been banned or disqualified from driving within the last 10 years;
      6. Have no more than one fault or outstanding incident/claim within the last 3 years;
      7. Have no medical conditions notifiable to the DVLA;
      8. Have not obtained a BA, DD, TT99 or UT conviction.
    5. Full Breakdown & Roadside Assistance in the event of any mechanical faults to the vehicle. Any issues relating to driver error are not covered by Calico Campers Ltd and are the full financial responsibility of the hirer.
  1. HIRE PERIOD
    1. Hire period relates to the times and dates agreed in the rental agreement.
    2. Minimum hire period is 2 nights and 5 nights in July and August.
    3. Rental is charged on a per night basis.
    4. Any extensions to the agreed hire period must be sought from Calico Campers Ltd. Extension may be granted subject to availability at extra cost. Payment must be made over the telephone via debit or credit card.
    5. Calico Campers Ltd will not make any refunds or reimbursements if the hirer returns the vehicle before the end of the hire period.
  1. DRIVERS & PASSENGERS
    1. Drivers must be aged between 23 and 75 during the rental period.
    2. Drivers must have held a full UK or EU driving licence for a minimum of 2 years.
    3. Drivers must not have had their driving licence suspended for any period within the last 3 years.
    4. Drivers must have no more than 6 penalty points on their driving licence.
    5. Drivers must not have been banned or disqualified from driving within the last 10 years.
    6. Drivers must not have more than one fault or outstanding incident/claim within the last 3 years.
    7. Drivers must not have any medical conditions notifiable to the DVLA.
    8. Drivers must not have not obtained a BA, DD, TT99 or UT conviction.
    9. Driving licences not issued in English language must be accompanied with a certified translation.
    10. Driving licence must be presented at time of pick-up and remain on the driver throughout the hire period.
    11. All drivers are subject to a driving licence check (via the DVLA website). This must be completed before the rental commences. Any driver who fails to meet the conditions set out within these terms and the rental agreement will not be permitted to drive a Calico Campers Ltd vehicle. No refund or reimbursements will be provided for losses incurred by Calico Campers Ltd in this instance.
    12. Only insurance provided by Calico Campers Ltd’s named insurance company and arranged through Calico Campers Ltd will be accepted for any rental period.
    13. Failure to declare any accidents or driving convictions will invalidate the insurance.
    14. Maximum of 3 drivers per rental of ‘DANI’ and 2 drivers per rental of ‘ARCHIE’.
    15. Insurance will cover damage to the vehicle and the property of Calico Campers Ltd. This does not include personal insurance for the hirer or cover any of the hirers personal possessions.
    16. Public liability insurance is included for the driver up to £2million.
    17. No travel insurance is included.
    18. Drivers will be responsible for any and all parking tickets, driving offences, speeding tickets and fines incurred during the hire period. An administration fee of £50 payable to Calico Campers Ltd will be incurred by the driver.
    19. Calico Campers Ltd authorises the use of ‘DANI’ for up to 4 passengers including the driver and for up to 2 passengers including the driver for ‘ARCHIE’. Each person is to ensure the use of the safety restraints provided at all times whilst the vehicle is in motion.
  2. SECURITY DEPOSIT
    1. The driver is subject to a security deposit of £1,200 to cover the liability of the driver in the event of damage.
    2. The security deposit is taken on the hire period start date.
    3. Debit or credit card can be used and the amount will be taken immediately.
    4. The security deposit will be refunded within 24 hours of return of the vehicle providing there are no outstanding claims.
    5. No other form of payment is accepted.
    6. The card used for payment must be in a drivers name.
    7. All security deposits will be in GBP.
    8. Calico Campers Ltd reserves the right to increase the security deposit amount.
    9. Deductions from the security deposit will be made in the following circumstances:
      1. To fund any losses or damages to the vehicle, its windows, equipment, fixtures, fittings, or any sign of negligent damage;
      2. To fund any damage to or loss of any purchased hire extras;
      3. To fund any damage to the vehicle in the obvious case of a pet having being left unattended;
      4. A fee of £50 will be deducted from the security deposit should the vehicle be returned in an unclean state;
      5. A fee of £50 will be deducted from the security deposit in the case of soiled bedding and/or mattress;
      6. If the toilet, waste and water tanks are not emptied prior to the return of the vehicle then a flat fee of £100 will be charged;
      7. If the hirer has smoked in the vehicle then a flat fee of £200 will be charged.
    10. Calico Campers Ltd are entitled to withhold the entire security deposit until the hirers liability and the amount of cleaning, damages or loss has been determined.
  3. SECURITY DEPOSIT EXCLUSIONS
    The hirer accepts that the limitation of liability to the contractually agreed security deposit does not apply to:

    1. Damage caused to the vehicle where the terms of the Rental Contract have been breached.
    2. Any damage or loss caused by a negligent act, or damage or loss intentionally caused by the hirer.
    3. Mechanical problems e.g. clutch/gearbox due to driver negligence.
    4. Replacement or repair of aerials, glass or wheels.
    5. Damage caused due to the use of incorrect or contaminated fuel.
    6. Missing wheel trims, tools or spares.
    7. For damages caused by neglecting proper operating procedures, e.g. incorrect fuel type and quality, ignoring oil or coolant levels, air pressure.
    8. Damage to the underside of the vehicle or the roof, which includes the overhead “Luton” area is deemed as gross negligence. Any such damage will be charged at a fixed cost of the full security deposit on the vehicle.
    9. The theft of the vehicle if the keys are left in the ignition or on the vehicle whilst unoccupied and the hirer shall be held fully responsible for a replacement vehicle.
    10. Damage caused to the windscreen, mirrors and/or tyre damage.
    11. For damage caused by the incorrect use of snow chains.
    12. Damage caused to the vehicle when using the vehicle in contravention of any legislation or regulation controlling vehicular traffic.
    13. Damage and associated costs with recovery of a bogged vehicle.
    14. Damage caused due to a single vehicle roll over.

In these cases, the hirer shall be liable for the full amount of damages.

  1. CAMPERVAN HIRE EXTRAS
    1. Calico Campers Ltd offers hirers of ‘DANI’ the opportunity to make additional purchases as below:
      1. Additional drivers – £15 per night;
      2. Pet hire – £20 per hire;
      3. Bedding – £20 per hire;
      4. Table & Chairs – £20 per hire;
      5. BBQ – £20 per hire;
    2. Calico Campers Ltd offers hirers of ‘ARCHIE’ the opportunity to make additional purchases as below:
      1. Additional drivers – £15 per night;
      2. Pet hire – £20 per hire;
      3. Thetford Porta Potti – £25 per hire;
      4. Table & Chairs – £20 per hire;
    3. Calico Campers Ltd may formulate promotional offers or bundles, prices of which will be reflected and updated on the website.
    4. All hire extras are the sole property of Calico Campers Ltd and any damages to said items will be the full financial responsibility of the hirer.
  1. VEHICLE PICK UP AND RETURN
    1. Pick up and return of the vehicle is to the agreed location provided by Calico Campers Ltd at time of booking.
    2. Pick up of the vehicle is 3pm unless otherwise agreed by Calico Campers Ltd and any additional premiums paid. The hirer should allow 1 hour in order to complete all paperwork and for Calico Campers Ltd to demonstrate the vehicle to the hirer.
    3. The vehicle must be returned at 11am and no later on the agreed return date unless otherwise agreed by Calico Campers Ltd. The hirer should allow 1 hour for the vehicle to be checked by Calico Campers Ltd.
    4. The hirer must advise Calico Campers Ltd if they are delayed for any reason and additional charges will be incurred to fulfil insurance criteria.
    5. All drivers must be present on collection of the vehicle.
    6. Calico Campers Ltd will supply the vehicle in a clean, safe and roadworthy condition which meets Calico Campers Ltd quality assurance along with all regulatory and registration requirements.
    7. The hirer agrees to return the vehicle without alteration or addition and in the same clean and tidy condition as accepted upon pick up.
    8. All equipment, tyres, accessories and parts will be returned on return of the vehicle.
    9. Ordinary wear and tear will be accepted with the exclusion of the gross negligence and windscreen damage as set out in these terms.
    10. The vehicle at all times remains the property of Calico Campers Ltd.
    11. Calico Campers Ltd will ensure the vehicle is ready for collection at the designated time as set out in the booking confirmation however certain circumstances may result in a small delay. No refunds can be provided if a delay in pick up occurs.
    12. The vehicle must be returned with the same amount of fuel as was first provided at time of pick up. The difference will be charged at £2 per litre plus a £20 service fee. This will be deducted from the security deposit.
    13. If the hirer fails to return the vehicle to the agreed return location, the hirer accepts liability for the full cost of recovering the vehicle, and any loss of earnings and the daily rental fees for the vehicle for the period which it is off the road.
  1. CANCELLATION & AMENDMENTS 

In the event of a cancellation by the hirer the following charges shall be incurred:

  1. Less than 6 weeks prior to rental start date – total cost of booking deposit.
  2. Less than 4 weeks prior to rental start date – 50% of the total hire charge.
  3. Less than 2 weeks prior to rental start date – 100% of the total hire charge.
  4. Amendments to reservation dates may be possible but will be charged in accordance with Calico Campers Ltd pricing structure.

Calico Campers Ltd reserves the right to cancel a reservation before, on or after the commencement of hire if:

  1. The hirer does not provide the valid identity documents as set out in these terms.
  2. Driving Licence(s) are not produced in accordance with the conditions of these terms.
  3. The hirer fails to share driving licence DVLA check code prior hire period start date.
  4. The hirer fails to provide funds for security deposit payment by credit or debit card.
  5. There are operational issues outside of Calico Campers Ltd’s control affecting the rental vehicles.
  6. The hirer is in breach of any terms in this agreement.
  7. The hirer obtained the vehicle through misrepresentation of fraud.
  8. The vehicle appears to be abandoned.
  9. The vehicle is not returned at the agreed date and time, or Calico Campers Ltd reasonably believes it will not be returned.
  1. CORONAVIRUS CANCELLATION & AMENDMENTS
    1. The hirer will be entitled to free booking amendments (subject to any increase in new booking dates) in the event of a Government-imposed national or local lockdown, as well as in the event of any changes to non-essential travel restrictions in the hirer’s area of residence.
    2. OR; A full refund will be provided to the hirer should the rental be unable to commence in the event of a Government-imposed national lockdown, or if a local lockdown prevents the collection of the Calico Campers Ltd vehicle.
  1. PETS
    1. All Calico Campers Ltd’s vehicles are pet friendly.
    2. A maximum of 1 domestic pet dog may be carried on a Calico Campers Ltd vehicle and must have been paid for at point of booking.
    3. A pet can be added to the booking at a later date with the expressed permission from Calico Campers Ltd and the additional hire charge paid.
    4. The hirer is solely responsible for ensuring compliance with the corresponding animal protection, carriage, vaccination and transit/entry requirements.
    5. Cleaning costs due to non-compliance or infringement of said regulations and any loss of profit subsequently incurred by Calico Campers Ltd due to any extended downtime will be the financial responsibility of the hirer.
    6. Strictly no pets to be left unattended at any time in any Calico Campers Ltd vehicle.
  1. VEHICLE USE
    1. The hirer agrees that during the rental period, only persons identified in the rental agreement as an authorised driver may drive the vehicle.
    2. The vehicle must always be driven in a cautious, prudent and normal manner.
    3. The vehicle must not be driven by anyone under the influence of drugs or alcohol or anyone whose blood alcohol or drugs concentration level exceeds the lawful limit.
    4. The vehicle must not be used for any illegal purposes.
    5. The vehicle must not be used for any race, rally or contest.
    6. The vehicle must not be used to tow any vehicle or trailer.
    7. The vehicle must not be used to carry passengers for hire or reward.
    8. The vehicle must not be driven in an unsafe or unroadworthy condition.
    9. The vehicle should not carry more persons than permitted at any time.
    10. The vehicle should not be left unattended with the ignition key in nor should the vehicle ever be left unlocked.
    11. All Calico Camper’s vehicles are fitted with GPS tracking devices.
  2. ACCIDENTS AND RESPONSIBILITY 
    1. In the event of any accident, loss or damage arising from the use of the vehicle, the hirer agrees to notify Calico Campers Ltd immediately.
    2. In the event of an accident or damage occurring to the vehicle, the hirer must complete in full the Calico Campers Ltd accident form.
    3. The hirer must assist Calico Campers Ltd and the police (where necessary) with any and all accident and/or road collision enquiries.
  1. VEHICLE BREAKDOWN
    1. Calico Campers Ltd will ensure the hirer has full documentation pertaining to the breakdown cover including contact information.
    2. The hirer agrees to notify Calico Campers Ltd of any motor breakdown immediately.
    3. The hirer agrees to follow the strict motor breakdown protocol as set out by Calico Campers Ltd in the event of a motor breakdown.
    4. In the event of damage, vehicle fault or a breakdown during the hire period, Calico Campers Ltd will endeavour to make any repairs necessary at the nearest available garage.
